Instituted in 1962, the 13th salary represents a relief for the Brazilian employee in the household budget and, therefore, is the most awaited salary.

For employees with a formal contract, retirees, pensioners and civil servants, the benefit, also known as Christmas bonus, must be paid by the employer in two installments: the first between February 1st and November 30th; and the second until December 20th.

CALCULATION OF THE 13TH SALARY

The 13th salary is calculated by dividing the full salary by 12 and multiplying the result by the number of months worked. Other installments of a salary nature, such as overtime, additional hours (night work, unhealthy work and dangerous work) and commissions are also included in this calculation.

10 THINGS YOU NEED TO KNOW ABOUT THE THIRTEENTH

1️⃣ The first installment of the 13th salary can be received during the holidays. In this case, the employee must request the advance in writing from the employer by January of the respective year.
2️⃣ The 13th salary can be paid upon termination of the employment contract, whether due to the end of the contract, when signed for a specific period, due to a resignation or dismissal, even occurring before the month of December.
3️⃣ An employee dismissed for just cause is not entitled to the 13th salary.
4️⃣ After 15 days of service, the employee is now entitled to receive the 13th salary.
5️⃣ INSS retirees and pensioners also receive the bonus.
6️⃣ An employee who has more than 15 unexcused absences in a month may have the fraction of 1/12th relative to the period deducted from their 13th salary.
7️⃣ The basis for calculating the 13th salary is the gross salary, without deductions or advances, due in the month of December of the current year or, in the case of dismissal, in the month in which the contractual termination was agreed.
8️⃣ If the deadline for paying the 13th salary falls on a Sunday or public holiday, the employer must bring it forward. If you fail to do so, you will be subject to a fine.
9️⃣ The employer will also be subject to a fine if they pay the 13th salary in just one installment.
🔟 The employer is not obliged to pay all employees in the same month, but must respect the legal deadline for paying the 13th salary, that is, between February and November.
